FACTS OF THE CASE
On December 10, 2016, at 10:30 p.m., 69-year-old AAA264352
was sleeping in her house when her brother-in-law, accused-appellant XXX264352
(50 years old), suddenly entered. The elderly victim reached for her bolo upon
seeing him approach, but accused-appellant held both her hands, pushed her
against the wall, and twisted her arm, causing the weapon to fall. He then
forcefully laid her down on the bed, pulled up her duster, forcibly spread her
legs apart, and had carnal knowledge of her against her will. After the sexual
assault, he warned her not to close the door as he would return.
The victim's daughter, CCC264352, was awakened by her
younger sister who heard their mother groaning in pain. Upon rushing to her
mother's nipa hut, she found AAA264352 crying and in distress. The victim
immediately disclosed that accused-appellant had raped her, prompting them to
report the incident to the police.
Dr. Medardo S. Estanda conducted a medical examination on
AAA264352 and issued a Living Case Report dated December 12, 2016, finding the
presence of spermatozoa in her vagina, consistent with previous sexual
intercourse.
Accused-appellant denied the charges, claiming he was at a
cockpit 11 kilometers away from 10:30 p.m. to 4:00 a.m. on the night in
question.
TRIAL COURT DECISION: The Regional Trial Court found
accused-appellant guilty beyond reasonable doubt of rape under Article 266-A(1)
in relation to Article 266-B of the Revised Penal Code. He was sentenced to
reclusion perpetua and ordered to pay PHP 100,000.00 each as civil indemnity,
moral damages, and exemplary damages, plus 6% interest per annum.
COURT OF APPEALS DECISION: The appellate court
affirmed the conviction but reduced the monetary awards to PHP 75,000.00 each
for civil indemnity, moral damages, and exemplary damages.
ISSUE BEFORE THE SUPREME COURT
Whether the Court of Appeals erred in reducing the civil
indemnity and damages awarded to the 69-year-old rape victim, considering her
status as a senior citizen and the heightened vulnerability associated with her
advanced age.
SUPREME COURT DECISION
The Supreme Court AFFIRMED the conviction but MODIFIED the
monetary awards. The Court ruled that considering AAA264352's advanced age of
69 years at the time of the rape, being a senior citizen, it was proper to
increase the awards back to PHP 100,000.00 each for civil indemnity, moral
damages, and exemplary damages.
The Court emphasized that the victim's straightforward,
candid, and categorical testimony, corroborated by medical findings showing the
presence of spermatozoa, sufficiently established all elements of rape. The
accused's weak defenses of denial and alibi could not overcome the positive
identification and detailed testimony of the victim.

"ACCORDINGLY, the Appeal is DENIED. The Decision dated
June 29, 2022 of the Court of Appeals in CA-G.R. CR-HC No. 03145 is AFFIRMED
with MODIFICATION.
Accused-appellant XXX264352 is found GUILTY of RAPE. He is
sentenced to reclusion perpetua and ordered to PAY AAA264352 PHP 100,000.00 as
civil indemnity; PHP 100,000.00 as moral damages; and PHP 100,000.00 as
exemplary damages.
The monetary awards shall earn 6% interest per annum from
finality of this Decision until fully paid."
